Myles’ practice focuses on business disputes. He works with public and private companies, as well as individuals. His current practice includes shareholder remedies, fiduciary disputes, securities and transactional litigation, commercial disputes, financial services disputes, and business torts. Myles also frequently provides clients with risk management advice with respect to corporate and commercial matters.
Myles is known for his sharp analytical skills, pragmatic problem-solving, and commitment to achieving favorable outcomes for his clients, whether through negotiation, litigation, or alternative dispute resolution.
With a career spanning multiple jurisdictions, Myles has advised clients throughout Canada, the United Kingdom, and Australia. Myles has appeared in all levels of court in British Columbia and has been recognized as a Litigation Star by Benchmark Litigation Canada since 2024.
EXPERIENCE
Recent experience includes:
- Acted for a Canadian public company in defending a petition brought by one of its US financiers alleging oppressive acts by the company and its directors.
- Acted for a private company and its directors in defending a claim involving allegations of breach of fiduciary duties, oppression, and breach of contract.
- Acted for a private company in a claim against one of Canada’s largest telecommunications companies involving allegations of breach of contract, repudiation, and breach of duties of good faith.
- Acted for the majority shareholders of a private company in defending a petition brought by minority shareholders seeking remedies under the oppression provisions and the just and equitable winding up provisions in the Business Corporations Act.
- Acted for a First Nation in enforcing a band council resolution against one of its members.
- Acted for a private forestry company in defending arbitration proceedings involving claims of breach of contract relating to alleged unpaid forestry royalties.
Notable overseas experience includes:
- Acted for Lloyds Banking Group in defending a claim brought by a group of shareholders relating to its acquisition of Halifax Bank of Scotland in 2008.
- Acted for the Royal Bank of Scotland (now NatWest Group) in defending actions brought by shareholder and investor groups claiming approximately £4 billion in connection with the bank’s 2008 rights issue.
- Acted for Commonwealth Bank of Australia in defending class action proceedings relating to $200 million in loans advanced for a failed forestry managed investment scheme.
- Acted for one of Australia’s largest asset fund managers in bringing a claim for misrepresentations and breach of warranty involving the purchase of a major coal-seam gas business.
In-House Counsel Experience:
Myles gained in-house experience from his time on secondment in the Global Dispute Resolution team at BNP Paribas Bank from 2018-2019.
